These General Terms and Conditions of Sale govern the sale of products to you by Florence & Ferrari. As used herein, the words "we", "us" or "our" refer solely to Provider and not to you. This Site is available for purchases to certain countries due to freight and transport limitations. Any terms and conditions not included herein are excluded. Your use of Florence & Ferrari and the website to purchase products indicates your agreement to follow and to be bound by these General Terms and Conditions of Sale.

ORDERS

All orders are subject to fax, phone or e-mail confirmation by us. Please note that the products displayed by Florence & Ferrari and the website may be out-of-stock or discontinued.

PRICES

All prices are in Australian Dollars. Prices may change without notice. The total invoice price (Total amount due) is inclusive of goods and services tax applied with individual State and local regulations if your shipping address is in Australia and certain other countries. We are currently not required to collect Sales Tax on items shipped to other destinations. An estimation of the tax charges will be indicated in the Confirmation page of the Shopping Bag. This estimation will also be equal or less than the appropriate goods and services Tax applied. Exact tax charges will be calculated automatically after your order is shipped and the final order total will be indicated in the invoice you receive with the Shipping Confirmation e-mail. Depending on the tax laws in each State, you may be required to pay Use Tax on purchases for which sales tax has not been collected. All prices are inclusive of customs and import duties.

DELIVERY

General

You are responsible for the delivery costs associated with the delivery of the product(s) you purchase as specified on your order confirmation. Orders are processed and shipped on business days only (Monday through Friday, excluding public holidays, Saturday and Sunday).

You bear all risks of loss and damage to the products from the time the product(s) have cleared our Distribution Centre (DC). Delivery is deemed complete and title to the products passes to you upon acceptance of delivery by a common carrier.

Each order can only be delivered to one address. If you require orders to be sent to multiple addresses you will need to place a separate order per address. Please ensure that all shipping information is correct prior to check out. Florence & Ferrari takes no responsibility for delivering to incorrect addresses supplied by customers.

Duties and Taxes

Your order may be subject to import duties and taxes, which are levied once your order reaches your country. Florence & Ferrari does not collect these duties and taxes. If you incur these additional charges, they must be rendered prior to your order clearing customs. You will be contacted by the freight forwarder prior to delivery.

Delivery Address

To avoid delays in receiving your order, Florence & Ferrari recommends that you have the item delivered to an address where someone will be available to sign for it. PO Box addresses will not be accepted. Florence & Ferrari will not be liable for packages sent to PO Box addresses as all orders require a signature upon delivery. Florence & Ferrari recommends you use an address where the delivery can be made between 9:00am and 5:00pm.

BINDING AGREEMENT

Our order confirmation and these General Terms and Conditions of Sale shall be deemed the final and integrated agreement between you and us on the matters contained in these General Terms and Conditions of Sale.

GOVERNING LAW AND CHOICE OF FORUM

The laws of the State of New South Wales, Australia (without giving effect to its conflicts of law principles) govern all matters arising out of or relating to these Terms and Conditions of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these General Terms and Conditions of Sale shall be brought solely in the City of Sydney, State of New South Wales.

SEVERABILITY

If any provision of these General Terms and Conditions of Sale is determined to be invalid, illegal or unenforceable, the remaining provisions of these General Terms and Conditions of Sale remain in full force to the extent permitted by law.

RETURNS AND REFUNDS

Return and Refund Policy forms an integral part of the terms and conditions of Sale.

Return Policy

If you have purchased your product(s) from a Florence & Ferrari outlet, you may return in person any unused product(s) within (20) days from the date of purchase.

The product you wish to return:

b) must be unused, unworn, unwashed and not damaged;

c) must be returned complete with all of its parts and accessories;

d) must be returned in its original packaging;

If all of these conditions are satisfied, we will refund the value of the returned product(s), good and service Tax included. We will not issue any refunds for returns that do not satisfy all of the conditions indicated above
WE RESERVE THE RIGHT TO DESIGNATE NON-RETURNABLE PRODUCTS. ANY SUCH DESIGNATION WILL BE NOTED ON THE PRODUCTS WHICH ARE NON-RETURNABLE.

WE OFFER NO EXCHANGES ON PRODUCTS PURCHASED.

We want to make sure that you are completely satisfied with your purchases on this Site. If, for any reason, you are not satisfied with your order, you may return any UNUSED product(s) within (20) days from the date of delivery. Before sending any products back to us, please make sure that all of the following conditions have been correctly satisfied.

Florence & Ferrari wishes to guarantee you are fully satisfied. For this reason, you have the right to return all purchases made on Florence & Ferrari Online Store, within (20) days from the date in which the order was delivered to you.

Florence & Ferrari Online Store will issue a full refund of the product price, less a Processing Fee of $5 for each returned order. The original shipping costs cannot be reimbursed.

Return Form

The product you wish to return:

a) can be sent back to us only after you have completed and submitted the Return Form available on the website or office within (20) days from delivery; by completing and submitting our Return Form you will receive your Return Number;

b) must be unused, unworn, unwashed and not damaged;

c) must be returned complete with all of its parts and accessories;

d) must be sent in its original packaging;

e) must be shipped back to our fulfillment house within (20) days from the date of delivery;

f) must be sent in one single shipment; products that belong to the same order must be returned to us at the same time; and

If all of these conditions are satisfied, we will refund the value of the returned product(s), good and service Tax included, less any processing fee and original shipping costs. We apply a $ 5.00 (AUD) processing fee on each return. Return shipping is free. We will not issue any refunds for returns that do not satisfy all of the conditions indicated above; provided, however, that you will have the option to request (within thirty (30) days of being notified that you are not entitled to a refund) that your merchandise be shipped back to you, at your own cost, in the condition in which it was received by Provider’s fulfillment house. Your written request to for the return of your merchandise must be made within thirty (30) days. Your written request must also indicate your agreement to pay for return shipping and your method of payment for such shipping. If you do not request the return of your merchandise within said thirty-day period, you authorize Provider, and any of its affiliates or agents, to dispose of such merchandise.

Refund Policy

Refunds are processed within approximately three (3) business days of our receipt of your return. Your refund will be credited back to the same method used to make the original purchase.

PROVIDER WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF FLORENCE & FERRARI AND THE WEBSITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. During a promotion period, if products run out due to the high volume of entrants and customers wanting to purchase the products and enter the promotion, customers will have to wait a minimum of 6 to 8 weeks for additional products to be manufactured and delivered to their address, however entrants will still be allowed to participate in the promotion and have a chance to win the prizes on offer. Customers and entrants will not be eligible for a refund, cash back and/or credit if they have to wait for their products to be delivered beyond the stated approximate delivery times or if they do not like the product for any reason.

Provider shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.
OTHER SITE POLICIES

All Site Policies are incorporated in these General Terms and Conditions of Use by this reference and, therefore, apply to your access to, use of and purchase of products from Florence and Ferrari. If you do not agree to the Policies, please do not use Florence and Ferrari.

You may purchase products from Florence & Ferrari only for personal use and not for resale.
